Terms and Conditions for Use of RAW Looks (“Terms”)
The following describes the terms and conditions applicable to your access and use of the rawlooks.com website and related services (“RAW Looks Platform”).
BY ACCESSING OR USING THE RAW LOOKS PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND TO COMPLY WITH ALL RULES AND POLICIES SET FORTH HEREIN.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE PLATFORM.
RAW Looks provides its services subject to the following conditions.
By using RAW Looks services, you confirm that you have read, understood, and accepted these Terms.
1. Scope and Subject Matter
1.1. These Terms & Conditions (“Terms” or “Agreement”) govern the relationship between K-Solutions GmbH, Industriestraße 33e, 81245 Munich, Germany (“RAW Looks”, “we”, “our”, or “us”) and the user of the RAW Looks online services (“User”, “you”).
1.2. RAW Looks operates an online platform available at www.rawlooks.com and related domains (“Platform”), which provides Users with access to product and service information from third-party companies and online shops (“Partners”). These offers are collectively referred to as Partner Offers and are provided to Users free of charge.
1.3. By registering on or using the Platform, the User agrees to these Terms. The Platform text is not stored for individual access; the current version is always available on the website for download and printing.
1.4. RAW Looks presents products, styles, and offers in collaboration with Partner Shops. For this service, Partner Shops may pay RAW Looks a fixed amount per click or, in some cases, a commission based on sales. RAW Looks itself does not sell, fulfill, or ship any products.
2. Affiliate Links and Commissions
2.1. RAW Looks operates as an affiliate platform. Many of the product links displayed are affiliate links that redirect Users to the Partner’s online store.
If a User clicks on an affiliate link and makes a purchase, RAW Looks may receive a commission or referral fee from the Partner.
2.2. RAW Looks is not a party to any contract between the User and the Partner. All transactions, payments, deliveries, and returns are handled exclusively by the Partner. The respective Partner’s general terms and conditions apply.
2.3. RAW Looks strives for transparency. The presence of affiliate links does not constitute an endorsement or guarantee of the Partner Offers. We aim to display Partner Offers accurately and fairly, but we do not warrant completeness or currentness of data provided by Partners.
2.4. This affiliate model is the commercial foundation of RAW Looks and allows the Platform to remain free of charge for Users.
3. Registration and Contract Formation
3.1. Users may use most Platform functions without registration. Certain features (e.g., wishlists, brand follows, product notifications) require registration.
3.2. By submitting the registration form, the User submits a binding offer to use the Platform as a registered member. RAW Looks accepts this offer by sending a confirmation email with an activation link. The contract becomes effective upon activation.
3.3. Users must provide accurate and complete information and are responsible for keeping their login credentials confidential.
3.4. Registration and membership are free of charge. Users can cancel their account at any time.
4. Partner Offers and Contractual Relationships
4.1. RAW Looks merely provides access to information supplied by Partners. RAW Looks and its Partners operate their websites independently.
4.2. Partner Offers shown on RAW Looks do not constitute offers from RAW Looks itself and are not invitations to purchase from us. When a User clicks a Partner Offer, they are redirected to the Partner’s website, where any potential contract is concluded exclusively between the User and the Partner.
4.3. Any rights, claims, or obligations related to a purchase arise solely between the User and the respective Partner.
5. Price Accuracy
RAW Looks aims to keep Partner Offer prices as up-to-date as possible and updates information multiple times daily based on Partner data feeds.
However, since data cannot be updated in real time, displayed prices may occasionally differ from the current Partner price or availability.
The price shown on the Partner’s website at the time of purchase is decisive.
6. Email Notifications and Newsletters
6.1. During registration, Users may voluntarily subscribe to our general newsletter via checkbox consent. This subscription can be withdrawn at any time using the unsubscribe link or account settings.
6.2. By liking or following brands and stores on the Platform, Users automatically agree to receive product recommendation emails about new items from those brands or stores. These emails are part of the Platform’s user experience and may be deactivated at any time in account settings.
7. Changes to These Terms
7.1. RAW Looks may modify these Terms for valid reasons (e.g., legal updates, service improvements) if the changes are reasonable for both parties.
7.2. The User will be informed of any proposed change by email or notification on the Platform. If the User does not object within six weeks after receipt of the notice, the amended Terms are deemed accepted. RAW Looks will inform the User about this legal consequence in the notice.
8. Termination
8.1. The User may terminate the agreement at any time without notice by deleting their account or sending an email to [Insert contact email].
8.2. RAW Looks may also terminate the agreement at any time without notice, especially in case of misuse or violation of these Terms.
9. Liability
9.1. RAW Looks is liable for intent and gross negligence, as well as for injury to life, body, or health, without limitation.
9.2. In cases of simple negligence, liability exists only for breach of essential contractual obligations (so-called “cardinal duties”) and is limited to foreseeable, typical damages.
9.3. Liability for data loss is limited to restoration costs that would have arisen with proper backup.
9.4. The above limitations also apply to employees, representatives, and agents of RAW Looks.
9.5. Mandatory statutory liability, such as under the Product Liability Act, remains unaffected.
10. Availability
10.1. RAW Looks operates its services with an annual average availability of 98%.
10.2. Downtime due to maintenance, updates, or force majeure events is excluded from this calculation.
10.3. RAW Looks may perform maintenance work with or without prior notice when necessary for data and operational security.
11. Ranking and Search Transparency
11.1. Partner Offers displayed on RAW Looks can be ranked according to multiple criteria, including:
– Compensation paid by Partners
– Product popularity among Users
– Quality and completeness of Partner data
– Expected conversion performance
11.2. The compensation paid by Partners and the popularity of the product are the most significant ranking factors.
11.3. RAW Looks may adjust algorithms or ranking logic to improve user experience or commercial performance, while maintaining fairness and transparency.
12. External Links
Our Platform contains links to third-party websites or services. RAW Looks has no control over and assumes no responsibility for the content, privacy policies, or practices of these third-party websites.
Users acknowledge that RAW Looks is not liable for any damage or loss arising from reliance on such external content.
We recommend reviewing the terms and privacy policies of any external sites visited.
13. Governing Law and Jurisdiction
13.1. These Terms and the legal relationship between RAW Looks and the User are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
13.2. If the User has no general place of jurisdiction in Germany or another EU member state, or moves residence abroad after registration, the place of jurisdiction is the registered office of K-Solutions GmbH.
14. Online Dispute Resolution
The European Commission provides an online dispute resolution (ODR) platform available at:
http://www.ec.europa.eu/consumers/odr
RAW Looks is not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.
15. Severability
Should any provision of these Terms be invalid, the remaining provisions remain unaffected. The parties will replace the invalid clause with one that reflects the original intent as closely as possible.
